Malignant Mesothelioma is an extremely rare form of cancer whose only known cause is prior exposure to asbestos. There are three main types of mesothelioma: pleural mesothelioma which impacts the lining of the lung, peritoneal mesothelioma which impacts the lining of the abdomen and pericardial mesothelioma which impacts the lining of the heart.
A mesothelioma diagnosis is unique for several reasons:
First, there is oftentimes a long latency or dormant period between when a person is first exposed to asbestos and when the mesothelioma appears. Oftentimes, our clients were exposed forty to sixty years ago only to wake up one day and find their lives completely devastated out of the blue.
Second, there are often multiple exposures to asbestos from a variety of different products that could have contributed to the mesothelioma developing. For example, someone could be exposed to asbestos containing joint compound while doing home renovations, asbestos containing brake dust while doing auto repairs and asbestos containing pipe insulation while working as a laborer. All of these different exposures may have contributed to a mesothelioma diagnosis and each of these products and may be a potential source of financial compensation.
Finally, asbestos fibers do not discriminate — meaning that non-occupationally exposed people like spouses and children could be exposed from their loved one’s work clothes or from something as innocent as a home renovation project or home auto repair. Many of the clients that we have represented over the years never handled asbestos containing products themselves; they simply were in the wrong place at the wrong time.
The conspiracy regarding the asbestos industry is well documented. These companies made a conscious decision to place their own profits over the safety and wellbeing of people. They made this choice because it was in their financial interest to do so and because they knew the long latency period between exposures and diagnosis would be many years; the companies could reap the financial windfall from their choice and pass the buck to someone else to deal with down the road.
The shameful asbestos industry has had devastating consequences for countless individuals and their families’ decades later. Parents who must bury their children; children who must grow up without their parents or grandparents and all of the physical and emotional pain that inevitably comes along the way. It didn’t have to be this way.
The financial consequences associated with a mesothelioma diagnosis are very real and oftentimes can create an avalanche of challenges which make an already challenging situation seem virtually impossible to overcome. Fortunately, there are things a mesothelioma patient and their family can do to take some control back over their circumstance. Pearce Lewis is here to help make things better.
